Measures for Emergency Management of Contingency Events
Article 1. To promptly identify and appropriately handle emergencies related to iron ore spot trading activities, minimize losses and impacts caused by such incidents, maintain trading order, and protect the lawful rights and interests of all trading parties, Beijing Iron Ore Trading Center Corporation (hereinafter referred to as “COREX”) has formulated these Measures in accordance with the “Measures for the Administration of Trading Venues in Beijing” and other relevant policies and regulations.
Article 2. The term "contingency events", as used in these Measures, refers to sudden incidents that differ from normal iron ore spot trading activities and have, or are likely to have, a significant impact on such trading activities or the lawful rights and interests of trading parties, thereby requiring emergency response measures.
Article 3. Contingency events mainly include:
1. Trading-related contingency events: including trading anomalies, system failures, cyber-attacks, information sabotage, server failures, etc.;
2. Dispute-related contingency events: including complaints and disputes;
3. Force majeure contingency events: including unforeseeable, unavoidable and insurmountable contingency events, such as natural disasters (e.g., earthquakes, typhoons, floods, epidemics) and social incidents (e.g., wars, strikes, riots);
4. Other contingency events: Incidents that fall outside the above categories but seriously affect iron ore spot trading or the lawful rights and interests of trading parties.
Article 4. COREX adheres to the principle of prioritizing prevention while combining prevention with emergency response in the management of contingency events. It is committed to the tenets of lawful conduct, strengthened management, unified leadership with tiered accountability, and prompt and effective response.
Article 5. COREX shall establish a Leading Group for Emergency Response to Contingency Events (hereinafter referred to as the "Leading Group"). The Leading Group is the leadership body for COREX's emergency response to contingency events. Its primary responsibilities include:
1. Deciding on the initiation and termination of emergency response to contingency events;
2. Determining emergency response plans for contingency events;
3. Directing emergency response operations for contingency events;
4. Organizing information disclosure during the handling of contingency events;
5. Coordinating communication and liaison with relevant government departments;
6. Summarizing and improving emergency response work;
7. Handling other matters related to emergency response to contingency events.
Depending on the nature and circumstances of specific contingency events, the Leading Group may establish Emergency Response Teams for Contingency Events (hereinafter referred to as "Response Teams"). The composition of the Response Teams shall be determined by the Leading Group as appropriate.
Article 6. COREX's procedures for prevention and emergency response to contingency events mainly include early warning and reporting, emergency response and post-event review and improvement.
Article 7. COREX shall immediately develop and implement emergency response measures in accordance with the circumstances, category, nature, and impact of the contingency event.
Article 8. If a contingency event involves significant issues or shows signs of deterioration, the head of the Leading Group shall immediately convene a meeting to deliberate and decide on appropriate measures, and promptly report to relevant regulatory authorities.
Article 9. After the emergency response to a contingency event is completed, COREX shall review and summarize the causes of the event, the response process, and the improvement measures. Lessons shall be learned, improvement measures implemented, and prevention and control capabilities enhanced.
Article 10. COREX attaches great importance to the prevention and emergency response of contingency events. In accordance with the principles of rapid response, efficient coordination, decisive action, and timely reporting, it strives to control incidents within the smallest scope and minimize potential losses to the greatest extent.
Article 11. COREX reserves the right to interpret and revise these Measures.
Article 12. Both Chinese and English versions are valid. In case of any inconsistency, the Chinese version shall prevail.
突發事件應急管理辦法
第一條 為及時發現并妥善處理鐵礦石現貨交易活動相關突發事件,最大限度地預防和減少突發事件造成的損失和影響,維護交易秩序,保護交易各方的合法權益,根據《北京市交易場所管理辦法》等政策法規,北京鐵礦石交易中心股份有限公司(以下簡稱“北鐵中心”)制定本辦法。
第二條 本辦法所稱突發事件是指突然發生的、有別于常態鐵礦石現貨交易活動的、已經或可能會對鐵礦石現貨交易活動或交易各方的合法權益產生重大影響的、需要采取應急處置措施予以應對的突發性事件。
第三條 突發事件主要包括:
(一)交易類突發事件:主要包括交易異常、系統故障、網絡攻擊、信息破壞、服務器故障等交易相關重大事件;
(二)糾紛類突發事件:主要包括投訴、糾紛事件;
(三)不可抗力類突發事件:主要包括不能預見、不能避免并不能克服的突發事件,例如地震、臺風、洪水、瘟疫等災害事件、戰爭、罷工、騷亂等社會事件;
(四)其他突發事件:不能歸為以上三個類別,但嚴重鐵礦石現貨交易活動或交易各方的合法權益的事件。
第四條 北鐵中心對突發事件實行預防為主、預防與應急處置相結合的原則,貫徹依法規范、加強管理,統一領導、分級負責,快速響應、果斷處置的宗旨。
第五條 北鐵中心設立突發事件應急處置工作領導小組(下稱“領導小組”)。領導小組是北鐵中心突發事件應急處置工作的領導機構,主要職責包括:
(一)決定啟動和終止突發事件應急處理;
(二)確定突發事件應急處置方案;
(三)指揮突發事件應急處置工作;
(四)組織突發事件處置過程中的信息披露;
(五)協調與政府相關部門等的聯絡和銜接;
(六)組織突發事件應急處置工作的總結與完善;
(七)突發事件應急處置過程中的其它事項。
根據不同的突發事件及突發事件情形,領導小組可下設不同的突發事件應急工作小組(以下簡稱“工作小組”),突發事件應急工作小組的人員構成由領導小組視情況確定。
第六條 北鐵中心突發事件防范與應急處置程序主要包括預警報告、應急處置、總結完善。
第七條 北鐵中心應根據突發事件的情況、類別、性質、影響等立即制定應急處置措施并實施。
第八條 突發事件如涉及重大事項或呈惡化趨勢,領導小組組長應立即組織開會審議處理,及時向相關監管部門報告。
第九條 突發事件應急處置完畢后,北鐵中心應對突發事件發生原因、處理經過及改進措施進行總結。吸取經驗教訓,落實改進措施,提高防控能力。
第十條 北鐵中心高度重視突發事件防范與應急處置工作,本著快速響應、高效協同、果斷處置、及時報告的原則,力求把事態控制在最小范圍,把損失降低到最低限度。
第十一條 本辦法由北鐵中心負責修訂和解釋。
